In the comments on the Decree of the Plenum of the Supreme Court of the Russian Federation dated November 23, 2010 No. 26 “On some issues of the applies by the courts of legislation on criminal liability in the field of fisheries and the preservation of aquatic biological resources (part 2 of Article 253, 258.1 of the Criminal Code of the Russian Federation)” and a resolution of 18.10.2012 No. 21 “On the application by the courts of legislation on liability for violations in the field of environmental protection and environmental management”, the problems that arise when putting into practice criminal law norms that provide for liability for environmental crimes, conclusions are drawn and scientifically substantiated recommendations on the most The controversial cases of qualifications of acts under the articles of Chapter 26 of the Criminal Code of the Russian Federation. The work provides a detailed analysis of both scientific literature and judicial practice in criminal cases of environmental crimes.
The author was a member of the working groups for the preparation of draft resolutions of the Plenum of the Supreme Court of the Russian Federation dated 10.10.2012 No. 21 “On the application of the laws on liability for violations in the field of environmental protection and nature management”, as well as decisions dated 05.26.2015 No. 19 “On amendments to some decisions of the Plenum of the Supreme Court of the Russian Federation”, therefore, the comments have reflected issues that caused the greatest discussions when working on projects.
