The concept of 'property' emerged and developed almost simultaneously with the appearance and progress of humanity. In its development, the concept of 'property' far outpaced the emergence of economic theory and legal theory, and by its economic essence, it should form the basis of these theories, as if forming their backbone. However, the interpretation of concepts related to property used by legislations and reflected in modern legislation does not always reflect the objective economic nature of property. This has led to the emergence of a number of legislative provisions that do not contribute to, but hinder normal social development. This work is dedicated to these issues.
