Readers are presented to the second, processed and supplemented publication of the book "Operational-search activity in the field of economics and taxation". In it, the author covers issues related to the implementation of operational-search activities aimed at counteracting crime, primarily economic and tax. It should be recognized that today the federal law "on operational-search activity" is perhaps the only one of the working and “tuned” tools in the hands of law enforcement defenders. These and some other circumstances are due to an attempt to conduct this complex analysis.
In addition to the legal framework for the implementation of operational-search activities at the legislative level, departmental regulatory legal acts of open access in this area (as of January 10, 2015) are investigated and commented on. A full analysis of the features of conducting operational-search measures in the field of economics and taxation is impossible without a detailed analysis of judicial practice to the issues. Therefore, special attention in the book is paid to the decisions of the European Court of Human Rights, as well as domestic higher courts.
One of the main goals of the horde is to obtain one or another information. In this regard, the author dwelled on the analysis of the legal regime of access to various types of secrets in the implementation of operational-search activities (tax, banking, commercial, lawyer, notarial, journalistic, medical, etc).
