The history of the court and justice in Russia. Volume 2. Monograph

The second volume of the collective monograph “History of Court and Justice in Russia” is devoted to the law and justice of the late Middle Ages. Attention in it is focused on the legislation adopted in the Moscow state at the end of the XV -XVII century (Judicials of 1497, 1550, 1589), as well as on the implementation of labial and zemstvo reforms (30-50s of the 16th century) The analysis was subjected to documents adopted during the Time of Troubles and the Civil War: the legislation of Boris Godunov, False Dmitry I and Vasily Shuisky, the district letters of the “seventh” government and agreements with the Polish king Sigismund III on the invitation of Korolevich Vladislav to the Moscow throne. The charter books of the robbery order (1616-1617, 1635-1648) and the indicated book of the Zemsky Order (1622-1648), which normatively restored the action of the province and zemstvo reforms that existed before the Moscow ruin, are analyzed. The Cathedral Code of 1649 with a postal analysis of criminal and civil law, as well as all novels in the field of judiciary and legal proceedings and additions of legislation adopted in 1669-1679, is examined in detail. A feature of the monograph is the analysis of not only legal proceedings, but also the execution of court decisions: the formation of a judicial executive apparatus, forms and methods of its activity. A separate section is devoted to the consideration of church jurisdiction and the characteristics of church legal proceedings.
