The presented textbook is prepared for individuals studying at the Russian School of Private Law of the Private Law Research Center named after S.S. Alekseev under the President of the Russian Federation. It is designed for in-depth study of the discipline "Monetary Obligations and Financial Transactions", which is taught at the Department of Financial Transactions and New Technologies in Law within the educational program "Master of Private Law".
The textbook presents the main theoretical positions on the problems of the theory of monetary obligations and basic financial transactions, both regulated by the Civil Code of the Russian Federation (bank deposit agreement, bank account agreement, loan agreement, credit agreement, assignment of monetary claim financing agreement), and not regulated by it (agreement on issuance and use of a bank card, acquiring agreement). The author's theory of settlement transactions is thoroughly examined, with analysis of each transaction. The most popular issues of legal regulation of digital ruble, cryptocurrency, digital rights, which are analyzed from a civil law perspective, taking into account the views expressed in both Russian and foreign legal literature, are separately considered.
In addition to studying the main problems of the theory of civil law in the field of financial transactions, students will be able to familiarize themselves with the most important legal positions of judicial practice.
Regulatory acts are used as of September 1, 2022.
