Medical practice is an old term that shows the specificity of the oldest type of professional activity, which emerged as a complex of explicit and implicit professional, ethical, legal, and other rules, norms, and prescriptions. In recent decades, this activity has been subjected to external and internal influences, not always justified and substantiated, leading to an increase in defects, errors, and conflicts in medicine. This edition explores a complex of issues related to the legal and ethical regulation of conflicts at various levels in domestic healthcare. The precondition for their formation is the dominance of a subjective approach to assessing the quality of medical care, stemming from the traditionally fiduciary nature of the relationship between the patient and the doctor. The modern transformation of this fiduciary relationship into a civil law service paradoxically reduced the level of responsibility of healthcare workers as professional performers, while simultaneously requiring the development of objective criteria for assessing the quality of medical services provided in accordance with current treatment protocols (clinical recommendations) and legislative provisions protecting consumer rights. The imbalance between the patient's inflated expectations and the emotionally burnt-out doctor's desire for quick and formal compliance with the minimum mandatory requirements of medical standards is an objective cause of conflicts at the 'doctor-patient' level. Various conflicts in medicine have become the subject of scientific research by the author's team, and the main generalized results are offered to the attention of legal experts, medical professionals, and representatives of civil society in Russia interested in resolving or mitigating the sharpness of the identified problems. The development of new technologies in medicine and healthcare (medical, biosocial, informational, managerial, etc.) not only does not reduce the number of disputes but in some cases only exacerbates them. Progressive movement forward, in addition to the technologization of various processes in the industry, presupposes the observance of proven ethical and legal principles. Furthermore, with the development of new technologies, new challenges, threats, and risks also emerge. Their minimization and mitigation are a highly complex task, in the solution of which a significant place should be occupied by modern doctrine formed on the basis of interdisciplinary and cross-sectoral approaches. The legislation is current as of January 1, 2023.
