The work on the problems of legality has connected the Institute and the Academy for three decades. The first edition, published by our organizations in 1998, actually revived this topic, which remained in the shadow after the collapse of the USSR. The second book was released in 2008 and contains a comprehensive analysis of the conceptual problems of legality in the next stage of Russia's development. This research takes it to a new level.
The authors' position is reflected in the understanding of legality as a measure of the action of the law. This required an analysis of the positive potential of the law and its active impact on ongoing events.
The position on the dynamics of the level of legality is justified, opening up possibilities for its measurement in various areas of human activity and in the process of implementing national and international legal acts. A system of scientific concepts has been developed that allows for an assessment of the dynamics of legality, a complex of questions about the regulatory resource of the law and the influence on it of such phenomena as legal culture, risks and discretion, and the state mechanism for ensuring legality. An analysis of the nature of legality in public administration has been conducted, the limits of state regulation have been considered, a typology of violations of laws has been proposed, and measures to counter corruption have been suggested. The role of the judiciary as a guarantor of legality is considered. Social-psychological aspects are particularly highlighted. For lawyers - scientists and practitioners, teachers, students and graduate students of law schools and faculties, as well as for a wide range of readers interested in the fundamental problems of legal theory, their modern understanding and prospects for solutions.
