The monograph is the first comprehensive study in the Russian doctrine, aimed at developing a theoretical structure of responsibility for violation of exclusive law, taking into account the principles of justice and proportionality. The authors substantiated the idea that such responsibility is of private law. It has a predominantly reducing character. The penalty function can and should be realized in relation to subjects deliberately using someone else"s trademark. In this case, when calculating the recovered compensation, not only the possible losses of the copyright holder, but also the profit received by the violator will have to be taken into account. The work formulated the conditions for reducing compensation, the circumstances subject to accounting for the calculation of the amount of compensation.
