The monograph analyzes the modern content of the ban on torture, presents the historical retrospective of the appearance of this prohibition, its consolidation in international legal acts, constitutions and industry laws. The legal positions of international organizations on complaints about the actions of officials of a number of states (committee against torture of the UN, the European Court of Human Rights, the Mazherian Court of Human Rights) have been identified. Particular attention is paid to the analysis of the foreign doctrine around the permissibility of a retreat from the prohibition of torture in relation to terrorists. The scientific publications of such well -known foreign scientists as M. Walzer, A. Dershovitz, M. Ignatieff, T. Meisels, G. Shu, etc. have been investigated.
