The monograph analyzes the negative manifestation of freedom of conscience and religion as in the internal sphere (forum Internet), and in the external sphere (Feram Externum), the author’s concept of describing the structure and content of negative freedom of conscience and religion is presented, and the permissible limits and restrictions on the freedom of religion in a negative measurement are clarified . The work introduces into a scientific circulation the concept of “the right to abandon the legal obligation to reasons of conscience and religious beliefs” as one of the elements of negative freedom of religion, the approaches to the legal definition of “religion” and “religious beliefs” were identified and analyzed. After analyzing the extensive judicial practice in cases of religious objections to the execution of regulatory requirements, the author develops criteria for assessing such objections that defend the right to refuse to reasons of conscience and religious beliefs and formulates scientific and practical proposals to improve the legislation and recommendations on the use of these approaches to the judicial argumentation. The book is focused on scientific and practitioners in the field of law, students, graduate students and teachers of legal universities and faculties of religious studies, and can also be of interest to judges, deputies, civil servants and for all who are fond of religion and law
