The monograph presented to readers is devoted to Uzufruct - a classic limited property law of a personal nature, which was born in Roman law and in the process of its reception was perceived by almost all the law enforcements of the continental type. In the work, the concept and content of the Uzufruct, its subjects and objects, the grounds for occurrence and termination, the features of implementation and protection are considered. The author conducted an analysis of the historical development of Uzufruct in Roman, foreign, Russian pre -revolutionary and Soviet civil law.
Considerable attention is paid to the comparative legal aspects of the problem under consideration-the theoretical and legislative design of the Uzufruct in European continental law (German, French, Austrian, Italian, etc) A special place is occupied by the analysis of the provisions on usufruct (the right of personal benefit) contained in the concept of the development of civil law of the Russian Federation and the bill adopted on its basis on the new version of section II of the Civil Code of the Russian Federation “Protective Law”. The legal constructions known to the Russian law and order are analyzed, which in their nature and content are similar to Uzufruct.
The content of the work is based on a complex, detailed study of a large number of legal and empirical sources.
The conclusions made by the author and the proposal formulated on their basis can be used to improve Russian civil law.
