The book is devoted to one of the central consequences of termination of the violated contract - the implementation of the return of the received. The study is based on a wide empirical framework, which includes the experience of the most influential law enforcements of the continental-European type and the countries of general law, forms the main approaches to the institution under consideration, shows why the models of its regulation proposed by modern law enforcement turned out to be internally contradictory, and offers some guidelines that could have would allow these contradictions.
This monograph is hardly of interest among specialists who see the value of a comparative legal study in the possibility of its immediate and direct practical application. The soil for such steps in the work is presented, however, the main goal was different-it is conceptually to understand the ball of contradictions that over the past two centuries does not let go of those who in any way in contact with the topic under consideration, but remains unnoticed for the rest of the professional community . In this part, the conclusions obtained may be interesting in research and teaching, as well as in improving legislation and law enforcement practice
