This monograph is devoted to the problems of a criminal case by the prosecutor. The work considers the historical aspect of the emergence and formation of the institution of the return of a criminal case for an additional investigation.
Particular attention is paid to the disclosure of the legal nature of enshrined in Art. 237 of the Code of Criminal Procedure of the Russian Federation of the Institute for the Return of the Criminal case to the prosecutor to eliminate the obstacles to its consideration by the court, the general features and differences with the institution of the return of the criminal case for additional investigation were identified. A separate chapter is devoted to the grounds for the return of the criminal case to the prosecutor, the content of each of them is revealed taking into account the latest changes in the legislation. The work indicates a number of problems of the procedural procedure for returning the criminal case to the prosecutor and proposed ways to resolve them. The conclusions of the author on certain issues are confirmed by examples from judicial and prosecutorial practice. The application gives the decisions and determination of the Constitutional Court of the Russian Federation on the return of the criminal case to the prosecutor.
