The monograph is devoted to the principle of equality of creditors (Pari Passu), the mechanism of the implementation of which is all bankruptcy. The publication analyzes the nature of the principle of equality of creditors, the forms of its manifestation (positive and negative), the types of such manifestations are classified. In particular, attention is paid to the issues of equality and inequality in the distribution of the bankruptcy estate (priority, segregation, subordination), opening of production, bankruptcy management and access to information. The risky theory of the principle of equality of creditors is justified. The elements of bankruptcy are revealed as a mechanism for the implementation of the principle of equality of creditors: a moratorium, establishing requirements, collecting and implementing a competitive mass, a collective form of calculations on the terms of priority and proportionality. In the analysis, the comparative legal method is widely used: the corresponding elements are disclosed in the law of Germany, France, Italy, Great Britain, the USA.
