The number of executions of enforcement proceedings in the bailiffs is increasing every year. However, the share of the actual execution of enforcement proceedings fluctuates around 50% These circumstances emphasize the relevance of the study of the legal status of the claimant. The claimant is a key subject of enforcement proceedings, since it is precisely by his appeal and in his interest that enforcement proceedings are excited and carried out.
In the book, the legal status of the claimant is analyzed and proposed areas of its further reform in order to comply with the principle of the main protection of the interests of the creditor (recoverer), designated in the decision of the Constitutional Court of the Russian Federation of July 12, 2007 No. 10-P.
Theoretical conclusions and provisions of the monograph, as well as proposals for the improvement and development of procedural legislation, can be used in legislative work and in law enforcement, in further scientific developments of the problems of judicial protection and ensuring the availability of justice.
