The director’s responsibility to the corporation for the losses caused to her in judicial practice

The work analyzes a forensic arbitration practice of applying norms devoted to the liability of persons included in the executive body (director, members of the board) and members of the board of directors for losses caused to the legal entity. For the first time in the Russian literature, an analysis of all judicial practice available at the current moment is being held accountable for these persons, while the judicial acts of the arbitration courts of the cassation instance, senior courts were considered, and in some cases there are also arbitration courts of appeal and even first instance. The study shows that in recent years not only the total number of claims for bringing directors accounted for, but also the share of cases in which such claims are satisfied with the courts have increased. The work has studied the most typical issues that are discussed in such cases, indicate areas of legal uncertainty, as well as some conclusions of political and legal properties indicating the further development of this institution
