The monograph is devoted to a comprehensive analysis of the theory of legislative regulation and the practice of detention on suspicion of committing a crime as a forced measure that limits the constitutional law of a person to freedom and personal integrity. The author departs from the traditional understanding of the detention of the suspect as an act of preliminary investigation and the institution of criminal procedure law. The detention of the suspect is considered as a complex, complex, multidimensional organizational and legal phenomenon, expressed in the constitutional basis and intersectoral law enforcement mechanism. The work is reflected in the problem of the essence, legal nature and normative regulation of the detention of the suspect, his goals and foundations are considered. Particular attention is paid to the problems of the actual detention and delivery of the hem, its interrogation and personal search, legal guarantees inherent in restriction of freedom and inviolability of the individual. Along with doctrinal and legislative issues, the author considers purely applied aspects, analyzes the difficulties that occur in modern law enforcement practice, and offers possible options for overcoming them. The legislation is given as of October 2018.
