The design of the inter -creditor agreement in the civil law of the Russian Federation

The intercredter agreement occupies a special place among all other contractual constructions, since the purpose of its conclusion is not to create certain obligations, but to the structuring of existing legal relations with the participation of the debtor and its creditors, the establishment of a certain procedure for their implementation, including on a dyspertic basis. The design of the inter -creditor agreement enables participants in the civil circulation to streamline their relations, fixing the conditions for the compromise with partners achieved as a result of negotiations in such a transaction, and increasing the guarantees of the most complete satisfaction of property requirements to the debtor.
The intercredter agreement can be used both for solving specific problems facing the participants in civil circulation at a certain point in time when they carry out entrepreneurial activities, and for the organization of a long-term business process, within which the agreement under consideration is used as a tool for collecting and distribution of the debtor"s revenue from the sale of goods, works or services.
In this book, based on the current judicial practice, an analysis of the model of the intercredter agreement and the preferences that it provides participants in civil circulation is given
