The book is a monographic work in which for the first time in the Russian science of competitive law a comparative legal analysis of the category of the debtor is carried out by the right of the failure (bankruptcy) of Russia and Germany. It includes the consideration of the features of historical and modern approaches to the study of the category of the debtor, problematic issues related to the recognition of non -confident (bankrupt) of certain types of subjects of law.
The author made a critical comprehension of the validity of proposals on borrowing the provisions of Germany’s failure in the competitive law of Russia. It is proposed to introduce into scientific circulation the category a person performing on the side of the debtor.
The presentation is accompanied by an extensive analysis of the doctrine and judicial practice. The category of the debtor is rightfully disclosed by the insolvency of Germany using sources that are currently absent in Russian scientific circulation.
