The monograph investigates the problem of targeted attitudes of the modern criminal process of the Russian Federation, as well as questions about the role and place of criminal proceedings in their achievement. The laws of the emergence and development of criminal proceedings, including the Russian criminal process, historically focused on making a fair decision based on a complete and comprehensive study, are analyzed. It is considered in what forms the court and other subjects of the criminal process of Russia participate in achieving the goals and objectives of criminal proceedings at various stages of the criminal case, the limits of such participation are determined.
The provisions of the Code of Criminal Procedure of the Russian Federation devoted to the regulation of simplified forms of resolution of criminal cases on the merits by the court in the manner of heads 40 and 40.1 of the Code of Criminal Procedure of the Russian Federation were studied. Proposals have been expressed to improve the legal regulation of the process of proving the circumstances of the criminal case in order to ensure the observance of the rights and legitimate interests of the individual without reducing the effectiveness of criminal attacks on public order.
