The monograph is devoted to the institution of subsidiary liability for the obligations of the insolvent debtor, taking into account the practice of its application as of January 2020, both substantive and procedural issues of the implementation of the above liability are analyzed.
The first group of issues includes the nature of such responsibility and its ratio with the requirement to recover losses, its foundations, the presumption of bringing to bankruptcy, the concept of controlling persons and the control period, the limitation of the defendant, the implementation of the claim to the subsidiary debtor after attracting and T.P. The second group included the problems of the right to submit an application, interim measures, evidence and evidence, consideration of requirements outside the case, etc.
