This book is the first work in which the issue of a subjective factor in civil law and its influence on the various stages of the existence of a legal relationship is comprehensively investigated. The principle of formalism, characteristic of Russian law, does not imply full accounting of the subjective factor, replacing it with various presumptions and analogies. The monograph contains a scientific analysis of various forms of manifestation of a subjective factor and its influence on the emergence, change and termination of legal communication. Accounting for a subjective factor allows you to form behavioral standards in the field of tort law and determine the content boundaries of such a principle as conscientiousness, in contractual law. The book conducts a comparative analysis of the system of general law and the continental system, within the framework of which the solutions to existing legal gaps are revealed
