For all the apparent simplicity of monetary obligations in practice, there are many important nuances that the participants in civil circulation must take into account, entering into contractual legal relations. When discussing the parameters of the planned transaction, they should choose those models of payment that most allow them to optimize their commercial risks associated with the performance of monetary obligations.
In this book, based on a large array of prevailing judicial practice, we decided to study such methods of structuring and fulfilling monetary obligations, as the use of prepayment and post -payment, including the rules on commercial lending, the application of the principle of Take or Pay) , models of doing business by subscription, setting a fee in the form of a percent of a certain cost and various options for determining the fee for the use of borrowed funds.
Given the large number of issues arising in practice, the book also explores the rules for the performance of the test, intercourse and salination on monetary obligations, the procedure for their fulfillment, taking into account the difference in time zones, as well as the features of the inclusion of monetary obligations in unexpected civil law contracts
