The book analyzes the concept of "state needs", an author’s approach to identifying criteria is proposed and justified to consider certain needs as state needs. Separate attention is paid to the Federal Law of April 5, 2013 No 44-ФЗ "On the contract system in the field of procurement of goods, works, services to ensure state and municipal needs, its place in the civil law system, a solution to the problem of collision of law regulations regulating legal relations related to the placement of procurement for the supply of goods, the performance of work, the provision of services for state needs. The issues of determining the legal status of persons participating in the placement and execution of state procurement, determining the moment of acquiring the status of a procurement participant by the indicated persons are considered. The sectoral affiliation of the state contract, its legal qualification and essential conditions are investigated, a forensic arbitration practice is analyzed. The features of the conclusion, amendment and termination of the state contract, the problems of liability under the state contract, the right to unilateral refusal to execute the contract are considered.
