Constitutional courts make sure that the actions of the state correspond to the constitution. The last word remains behind them, when it comes to interpretation of the provisions of the Basic Law of the country, everyone must follow their interpretation of this law. If the words about the rule of law are recorded in the Constitution, not just for beauty, the state must exist in a truly working system of constitutional justice, which, if necessary, can remind other branches of state power about the legal framework in which they act. Without a constitutional court, it is impossible to imagine a rule of law, it protects the basic rights of citizens and is on guard of democracy. All state authorities must respect the independence of the Constitutional Court and ensure it.
Constitutional courts of European countries intensively exchange experience in the field of procedural practice and constitutional justice. Institutional conditions for this are created by the conference of European constitutional courts, created in 1972. The Federal Constitutional Court of Germany was one of its founders, the Constitutional Court of the Russian Federation joined the conference in 1996.
Many constitutional courts publish their decisions not only in the state language of their country, often at least the most important, fundamental decisions are translated into English. However, translations into other languages are rather an exception.
Over the past years, the Conrad Foundation Adenauer has repeatedly prepared translations of decisions of the Federal Constitutional Court of Germany into various languages, this work invariably met a positive response. Therefore, the idea of translating the actualized meeting of decisions of the Federal Constitutional Court and into Russian suggested itself itself.
This collection contains 213 decisions of the Federal Constitutional Court of Germany.
