The publication justifies the formation of the Institute of Marine Cargoes related to a certain commodity nomenclature of foreign economic activity, where they are recognized as dangerous for people who are on board the vessel, its mechanisms, and finally, the seafood, peaceful passage.
It is obvious that the cross -border movement of these commodity parties (completely sea) is carried out in accordance with legal acts designed to overcome the competition of national civil laws. In this regard, the systematic nature of the new legal institution, industry, intersectoral conditionality of the norms affecting private law relations are shown.
The analysis of the conflict and substantive regulation of legal relations of cross-border marines, their institutional principles is presented. Those attachments that acquire a truly determining nature are outlined. The references to the law enforcement are also considered, according to which positive legal regulation of insurance obligations is carried out. Hence the conclusion about the increasing importance of the insurance function, since the assignment of the right to the category of contractual ones arising after the choice of the right to the category is carried out on account of the upcoming compensatory payments when the costs are assigned to the policyholder. On the contrary, the powers of the insurer are qualified more clearly, it is enough to only indicate the transaction in relation to the insurance amount and value.
Analysis of the marine transportation of dangerous goods as a separate legal institution gains special value due to the need for frequent interpretation of the dispositive and bilateral formulas of attachment, the allocation of the legal principle of equality of counterparties rights.
