The monograph proposed to the reader is a continuation of many years of scientific and practical activity of the author. The material set forth in the book is the result of the development of theoretical problems and specific regulatory legal acts, participation in the work of central and local state authorities, scientific conferences and seminars, conducting research in the regions of Russia, discussions with foreign scientists.
The plan of the monograph is to overcome the purely “text” approach to the right and absolutization of the very fact of the adoption of a legal act, to correlate legal constructions and phenomena with objective trends in real processes in the economic, social, political and scientific and technological spheres. The study uses the methodology of intersectoral analysis of the combination of branches of national law, on the one hand, and the principles and norms of international law, on the other. Methods of increasing the transforming role of law and its advanced creative impact on processes in society have been developed.
