Possession and its protection are one of the most interesting, but at the same time ambiguous and difficult to understand civil law institutions. The proposed work is a systematic study of this phenomenon.
In the work on the basis of the study of domestic and foreign theoretical, legal and empirical material, theoretical and practical problems of possession protection are comprehensively considered, and options for their resolution are proposed.
The author conducted an analysis of the historical development of the institution of possession and its protection, the scientific positions on the nature of ownership and its protection were studied, constitutive features were identified and the concept of ownership (post -terrain) protection was identified, the design of the possession planned for consolidation in the Civil Code of the Russian Federation was identified, and forms were analyzed And the ways of protecting ownership, the concept of a ownership is determined, its constitutional features have been investigated.
The conclusions made by the author and the proposal formulated on their basis can be used to improve Russian civil law.
The legislation is given as of September 2018.
