The work studies the theoretical and legal foundations of providing the prosecutor with the procedural guarantees of the rights of suspects (accused) and victims, considered issues such as the essential characteristics of the definition "guarantee", the role of the prosecutor in ensuring the rights and legitimate interests of participants in the criminal process, the correlation of the procedural statuses of the main participants in criminal proceedings . Typical violations of the rights of the participants in criminal proceedings, etc. have been determined.
