The book is devoted to one of the most important issues of civil legislation of the last decades - a system of property rights, which is considered by the author on the example of ownership and use of other people"s premises. The work investigates the current limited property rights of citizens to residential premises indicated in civil and housing legislation and provoking the greatest discussions and disputes, as well as rights, which are by nature property, but today have not received proper legislative regulation or have not found their own at all legislative consolidation in the transition from the norms of Soviet housing law. Highlighted on the basis of generic and proposed species features of law are connected by the author into a single design, a single limited property law - the right to benefit, for which personal easements of ancient Rome and housing easements of European legislation of Germany, France and other European countries are taken. The author paid much attention to the distinction between property, obligatory and corporate rights to residential premises. The work also analyzes the draft Federal Law No. 47538-6 "On Amendments to Part The First, Second, Third and Fourth Civil Code of the Russian Federation, as well as certain legislative acts of the Russian Federation, who are proposed to introduce a limited property right of the personal and the personnel right and to introduce into civil circulation Social benefits for residential premises are given practical advice on its refinement and changes.
