The study analyzes theoretical and practical issues that arise in judicial practice when considering property disputes of spouses, including those related to the ownership of spouses and other business assets. Attention was paid to the problem of indirect possession of assets, theory and practice of "removal of the corporate veil". The presumption of "consent of the spouse" is discussed to dispose of the second spouse with common property. The existing judicial practice on this problem is considered, including the decisions of the Supreme Court of the Russian Federation. The main attention is paid to the gaps that exist in this area in the family law of the Russian Federation. Legislative initiatives to change family legislation entered the State Duma in November 2019 are analyzed. Proposals for improving legislation are given
