The monograph studies the philosophical and legal substantiation of the categories of freedom and arbitrariness in Russian civil law, their concept and content, as well as interaction and mutual influence. The issue of the ratio of freedom and arbitrariness in contractual relations, in property relations and intellectual property has been considered. Thus, in contractual relations, special attention is paid to the specifics of the ratio of freedom and arbitrariness of the participants in the contract at the stages of its conclusion, execution, change and termination. In the property relations, these categories are investigated in the acquisition of ownership, as well as in the process of owning, using and termination of ownership. In a section on intellectual property, freedom and arbitrariness of subjects are considered in relations on the use and disposal of intellectual property objects.
