The privatization of the dwelling is one of the most important legal guarantees aimed at implementing the guaranteed part 1 of Art. 40 of the Constitution of the Russian Federation the rights of each to the dwelling. Social housing hiring, although it gives certain advantages to the employers, is it precisely the ownership of the dwelling on the right of ownership is the cherished dream of the vast majority of citizens, since it allows them to concentrate in their hands full control over this asset having a high market value.
Despite the comparative simplicity of the very procedure for the privatization of residential premises, in practice, citizens quite often encounter difficulties that intentionally or without guilt create public authorities, evading the issuance of orders and providing housing under social contracts, and the registration of public rights property that inhibits the process of free transfer of housing to private property.
Based on a large array of judicial practice of various regional courts, this book explores such topical issues as the conclusion of a social rental agreement and the legal regulation of privatization /deprivation procedures, including the privatization of residential premises with disputed legal status (reconstructed housing and non -residential premises , transferred to residential premises), recognition of the agreement by invalid and inheritance of an unreasonable apartment, maintaining the right to use persons who did not participate in privatization, as well as protecting the rights of the buyer of a privatized apartment and the conditions for the court appointing compensation for the loss of housing
