The monograph is a comprehensive study of the problems of the action of prejudice in the civil and administrative proceedings of Russia. This publication considers the history of the formation of the Institute of Prejection, a review of the basic principles of the prejudice in foreign law enforcement (for the example of the United States, England, Germany and France) is given, and theoretical and practical issues related to the application of procedural norms on prejudice have been studied.
The work includes an analysis of the rules of the prejudice enshrined in the CAS of the Russian Federation, and also takes into account the short stories of the Federal Law of November 28, 2018 No. 451-ФЗ. The work was prepared without taking into account changes in the procedural legislation provided for by Federal Law of July 18, 2019 No. 191-ФЗ, which require a separate consideration.
The publication is addressed to scientists and practicing lawyers, judges, teachers of legal universities, graduate students and students, as well as all the problems of prejudice in civil and administrative proceedings
