Limits of exercise and protection of the patent owner"s exclusive right

The book presents the theoretical design of the limits of the implementation and protection of the exclusive law of the patent holder. The author substantiates the idea that the volume of legalization models (ways of exercising law) available to the patent holder is functionally determined. It depends on the essence of the object of patent rights and the conflict of interests arising in relation to it, evaluated from the position of the appointment of exclusive law. Based on the analysis of foreign experience and law enforcement practice, the author considers possible mechanisms to combat unscrupulous patenting strategies, licensing practitioners. Particular attention is paid to the problem of antitrust impact on patent relations, possible conditions and grounds for compulsory licensing
