This monograph is devoted to the study of a set of problems relating to the socio-legal conditioning of the composition of fraud in the field of lending and the validity of the application to persons who have committed fraudulent actions of this type, criminal law enforcement in connection with their positive post-criminal behavior. The valuation of the validity of the legislator is evaluated by constructing the composition described in Art. 1591 of the Criminal Code of the Russian Federation, differentiation of responsibility for fraud in the field of lending. Theoretical approaches to the practical implementation of the grounds for the application of criminal law incentives for positive post-criminal behavior in relation to the relevant crimes of the persons established by the legislator. The monograph contains a number of new recommendations for improving criminal legal means of preventing fraud and optimizing the practice of their application.
