The scientific concept of the legal recommendation has been developed, its content, functional value and ways to update state and public law for modern Russia have been identified, new approaches to the disclosure of the main factors that reduce the effectiveness of the implementation of the legal recommendation were proposed, and the prospects for the development of the institution of legal recommendation in the science and practice of the institution were proved, and the general legal is first justified by the general legal The status of the phenomenon under consideration introduced the author’s definition of the concept of "legal recommendation", the place of legal recommendation in the mechanism of legal regulation was revealed, the role of the state in the processes of developing and implementing legal recommendations was shown.
