This monograph is devoted to the study of the structures of legal presumptions in the framework of judicial administrative procedural law in the conditions of allocation at the present stage of administrative proceedings as an independent form of exercise of the powers of the judiciary.
In order to identify the specifics of legal presumptions in this area of legal regulation, the author discusses in detail the issues of the place of norms governing administrative proceedings, in the system of Russian law, their legal nature. Such approaches to resolve this issue as an understanding of these norms as an independent branch of law, the Institute of Administrative Law, and the sub -sectors of civil procedural law are analyzed in legal science.
A significant part of the study concerns the theoretical basis of legal presumptions in judicial administrative procedural law, their essence, legal nature, signs, functions, the action at certain stages of the judicial administrative process, is revealed, their own definition of concept is proposed. In addition, based on the current procedural legislation on administrative proceedings, judicial practice, legal doctrine, the author proposed the most optimal models regarding the types of legal presumptions in the designated field.
