The book discusses the problems that arise during the qualification of unlawful legal actions as the grounds for the occurrence of civil rights and obligations. The author considers the main approaches to the concept, qualifications and structure of unlawful action, paying significant attention to the problems of preventive legal influence in order to prevent illegal behavior. In the monograph, unlawful behavior as a generic concept, covering many various phenomena entailing different legal consequences, and a civil offense as a special case of unlawful action, which is the basis of legal liability, is distinguished. The author’s interpretations of the understanding of the object, the objective and subjective side of the unlawful action are proposed, and the individual varieties of illegal actions in civil law are considered. The work provides and comprehend the legal positions of the Supreme Court of the Russian Federation on certain problems of qualification of unlawful action.
