Reprinting of the famous book of Yuri Churilov "Judicial precedents for practicing lawyers".
In Russia, a judicial precedent is not recognized as an official source of law. While scientists are arguing about the role of a judicial precedent in the Russian legal system, practicing lawyers attribute him to the reality that they have to face every day, because laws usually cannot be used until their provisions are clarified by the courts.
In contrast to the published collections of judicial practice in this collection, only those precedents (both higher courts and lower courts) are included in this collection, which may be useful to practicing lawyers in their daily work in various branches of law. The choice fell precisely on the most indicative, interesting and illustrative court decisions, which either simplify the understanding of complex legislative formulations, or contain their unusual interpretation compared to the literal text of the law. In addition, the collection provides conflicting judicial precedents adopted by the courts of the same or different levels. By this, the author wanted to show that the reference in court to the precedent is a fairly insidious thing.
The collection can be useful to both practitioners and scientists, students of law universities, as well as all readers interested in jurisprudence
