The fifth edition of Mikhail Treushnikov’s monograph “Judicial Evidence” investigates theoretical and practical problems of proving and evidence in civil and administrative proceedings, taking into account the renewal of Russian procedural legislation, changes in the judicial system, and the theory of evidence -based law.
The significance of judicial evidence is considered as means of achieving the correct knowledge of the actual circumstances of the case and the justification of the court’s conclusions in the decision, their classification is given. Current trends in the development of the evidence system are shown in connection with the updated content of the principle of adversarial and strengthening the activity of the parties.
Certain types of evidence are studied, the specifics of their assessment by the court. The views of scientists expressed in connection with the practice of applying the norms of the Code of Civil Procedure of the Russian Federation and the APC of the Russian Federation for more than ten years are presented. The scientific provisions of the theory of evidence in civil proceedings are also applicable in administrative proceedings, since they reflect the centuries -old experience of the Russian Legal School on the theory of evidence.
The book is designed for students, graduate students, teachers of law universities, scientists, judges, representatives of the parties and other practical employees of justice. It can be used as legal literature on the special course “Evidence” and when writing coursework and thesis by students studying under the programs of undergraduate and graduate programs
