The monograph explores legal norms that regulate relations on financial recovery and failure (bankruptcy) As a result of the study, the author concludes that at the present stage of its development, these norms formed a new institution of law - the institution of insolvency. Within the framework of this institute, the author identifies and examines in detail two subin -institutes: the subinstate of financial recovery, the norms of which ensure the restoration of the solvency of the debtor, and the subin -institute of competitive law, the norms of which regulate the termination of the debtor, the restoration of solvency of which is not possible. The legislation is provided as of April 2017. The work is designed for lawyers and economists interested in insolvency problems. The monograph can be used by students and teachers of law universities
