The work is a monographic study of the hereditary position of the child in the Russian Federation. It discusses the theoretical and practical aspects of the problems of hereditary legal capacity and legal capacity of the child, the exercise and sews the rights of the child, including those who remained without parental care. The hereditary rights are classified. Proposals have been made to eliminate identified problems by improving inheritance legislation. The materials presented in monographs are based on the analysis of scientific and normative literature, as well as judicial practice. The author is a candidate of legal sciences, assistant judge of the Moscow City Court.
The work is presented and scientifically substantiated the concept of the compatibility of the child’s independence in the exercise of hereditary rights, the care of the state and the responsibility and good faith of legal representatives, other persons participating in the exercise of the inheritance rights of the child.
