The monograph is devoted to the study of the complex socio-legal phenomenon of the independence of judges in the system of criminal procedure relations arising within the framework of court proceedings. Theoretical and practical problems of the implementation of the independence of judges were identified and analyzed when they use specific criminal procedure norms and institutions requiring the judge of choosing between the formulation and justification of their own legal position in the case under consideration and joining the position proposed by someone else.
For the first time at the monographic level, provisions have been developed that substantiate the need to reform the criminal procedure law to establish the optimal procedural mechanism that ensures the freedom of judges in the choice of a legal position and excludes any extraneous impact on the judge when making a decision.
The legislation is given as of August 1, 2021
The book is intended for students and graduate students of law universities, judges, law enforcement officers, lawyers, as well as for a wide range of readers interested in justice problems
