The monograph is devoted to the study of the characteristics of the legal regulation of the basic social rights and freedoms of man and citizen when using systems and technologies of artificial intelligence. The study shows the transformation of the content of basic social rights and freedoms, due to the development of artificial intelligence and its application in the social sphere.
The authors are given arguments in favor of the ambivalence of digitalization and the introduction of artificial intelligence in the sphere of realization of social rights and freedoms.
The prospects and risks of this process are identified and indicated, the complexity of the application of legal responsibility for violation of social rights of human rights realized using artificial intelligence is justified. The foreign experience of applying artificial intelligence systems and technologies in the implementation of social rights and freedoms has been analyzed. The author’s draft Federal Law on Basic Guarantees of the Rights and Freedoms of Human and Citizen is proposed when using artificial intelligence.
