The concept and phenomenon of imaginary competition as an imaginary, apparent, but not actual in reality rivalry of business entities are considered. The typology of imaginary competition and the most common forms of illegal behavior of participants and organizers of tenders, which have signs of imitation of competition, are given. The international and foreign experience of combating imaginary competition at the auction has been evaluated. Proposals for improving law enforcement practice on the elimination and minimization of the causes and conditions that contribute to the increase in the quantity and danger of cartels and organized fraud at the auction have been formulated.
