Guarantee. Commentary on the decision of the Plenum of the Supreme Court of the Russian Federation of December 24, 2020 No. 45

The decision of the Plenum of the Supreme Court of the Russian Federation of December 24, 2020 No. 45 “On some issues of resolution of disputes on guarantee” is a large -scale document containing a significant number of legal positions of the highest court, which are analyzed in this publication. The understanding and assimilation of such numerous and detailed approaches of judicial practice to interpret the norms of the law on guarantee is a difficult task, to promote in solving which this book is called upon. Although the guarantee is a classic representative of the system of ways to ensure the fulfillment of an obligation, which has long -standing traditions dating back to Roman law, both in science and in practice, there are still many difficult questions, the search for answers to which is an urgent task of modern jurisprudence. In the commentary, an attempt was made by a scrupulous analysis of the text of the resolution of the Plenum, the development and change of legal positions are considered, discussion aspects and legal risks in this area of ​​legal relations are revealed. In relevant comments, some recommendations for contractual work are formulated when concluding guarantee agreements.
