The monograph discusses both types of fraud, which is the theft of someone else"s property, which is not such. Particular attention was paid to fraud in the field of contractual obligations, when a person receives property from a counterparty under an agreement, obviously not an intention to fulfill a counterclaim. In such situations, the behavior of the recipient of the property is objectively anti -amendment and draws up a civil offense. At the same time, against this background, the criminal law signs of fraud as the theft are especially relief.
The author made an attempt to debunking the myths who have established themselves in the forensics, such as the myth of the impossibility of acquiring the right by criminal means, that the gratuitousness as a sign of theft takes place and with insufficient equivalence, about the presence of direct intent to theft if the person is assumed by a person high -risk obligation, etc.
