In 2021 The publishing house International Relations published a monograph Criminal prosecution as a means of resolving an economic dispute: which is not so in the criminal and criminal procedure codes. Continuing the topic, in this book, its authors propose to solve the problem of permanent movement of economic disputes to the sphere of criminal proceedings by transferring criminal cases on “entrepreneurial” crimes to the jurisdiction of arbitration courts with the consideration of such cases in a lawsuit according to the rules of arbitration proceedings. This will allow a joint economic dispute and a criminal case associated with it, which will exclude the possibility of satisfying such requirements within the framework of criminal proceedings that would have no chance of success in the arbitration court. This will be eliminated the main motive for the initiation of “custom -made” criminal cases against entrepreneurs. The practice of resolving the arbitration courts of cases of administrative responsibility, which is analyzed in the work, clearly shows that within the framework of arbitration proceedings, cases that differ in the procedure for consideration may be united, which indicates the possibility of trouble -free integration into arbitration proceedings as well as criminal proceedings. Are there any constitutional obstacles to such integration? Do the latest amendments be created in the Constitution to expand the competence of arbitration courts in the aspect under consideration? Why did you need to allocate arbitration proceedings in the Constitution, and what is the fundamental difference between the latter and other types of legal proceedings - civil, administrative and criminal?
