The monograph presents the author"s substantiation of the phenomenon of the constitutionalization of the right as an urgent trend of Russian constitutionalism and the main provisions of the general theory of this process. From the standpoint of constitutional suggestion, it is shown how the current positive right and the form of its expression (objectification) can also acquire the necessary quality of constitutionality, reliably providing inalienable rights and freedoms of a person and a citizen, as well as a balanced harmonization and protection of other constitutional values. Taking into account the idea of the Constitutional Court of the Russian Federation as a legitimate subject of the constitutional lubility, an analysis of acts and legal positions (privileges) of this body of the Russian constitutional justice is given. According to the author, the implementation of the provisions of the general theory of constitutionalization methodologically provide the necessary subsequent cognition of constitutional and legal matter, its qualitative characteristics, elementary content and forms in all sectors and spheres of public and private law, the use of the results obtained for constitutionally reliable goals and objectives of legal practice.
